kiriclip — DMCA / Notice-and-Takedown Policy
Effective date: 2026-04-27 Last updated: 2026-04-27
1. Our policy
kiriclip respects the intellectual-property rights of others and expects users to do the same. We comply with the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512) and respond promptly to clear notices of alleged infringement.
2. Designated agent
Notices of claimed copyright infringement and counter-notices should be sent to our designated agent:
Designated DMCA Agent — Zynth LLC (kiriclip) Zynth LLC, Legal Department Sheridan, Wyoming, USA Email:
legal@kiriclip.comTelephone: on file with the U.S. Copyright Office
We strongly prefer notices by email; email notices are processed faster than postal mail. The full agent record (including telephone number and street address) is registered with, and available from, the U.S. Copyright Office Designated Agent Directory at https://dmca.copyright.gov/.
3. How to submit a notice of alleged infringement
To be effective under the DMCA, your notice must be a written communication that includes substantially the following (17 U.S.C. § 512(c)(3)):
- Your physical or electronic signature (typed full legal name suffices for an electronic signature);
- Identification of the copyrighted work that you claim has been infringed (or a representative list, if multiple works at one site);
- Identification of the material that is claimed to be infringing, with information reasonably sufficient to permit us to locate it on kiriclip — typically the kiriclip URL of the clip or the clip ID shown in the clip's metadata;
- Your contact information: name, mailing address, telephone number, and email;
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
- A statement that the information in the notice is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Send notices to legal@kiriclip.com with subject line DMCA NOTICE. A template appears at the bottom of this document for convenience.
Misuse warning. Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages. Do not submit a notice unless you are the copyright owner (or authorized agent) and reasonably believe the use is unauthorized.
4. Our response when we receive a valid notice
When we receive a notice that substantially complies with Section 3, we will:
- Remove or disable access to the identified material expeditiously (typically within two business days).
- Notify the user who uploaded the material, providing them with a copy of the notice and explaining their right to file a counter-notice.
- Forward the notice to law-enforcement or other authorities if required by law.
- Track the notice against the user's account in our internal repeat-infringer log.
If a notice does not substantially comply with the DMCA's requirements, we may decline to act and will explain what is missing so the sender can re-submit.
5. Counter-notice procedure
If you are a kiriclip user and believe your material was removed in error or as a result of misidentification, you may submit a counter-notice. To be effective (17 U.S.C. § 512(g)(3)), it must include:
- Your physical or electronic signature;
- Identification of the material that has been removed or disabled and the location at which it appeared before removal;
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
- Your name, address, telephone number, and email, plus a statement that you consent to the jurisdiction of the U.S. federal district court for the judicial district in which your address is located, or, if your address is outside the United States, the U.S. District Court for any judicial district in which kiriclip may be found, and that you will accept service of process from the person who sent the original notice or that person's agent.
Send counter-notices to legal@kiriclip.com with subject line DMCA COUNTER-NOTICE.
6. Our response to a valid counter-notice
When we receive a valid counter-notice, we will:
- Forward it to the original complainant within a reasonable time;
- Inform the complainant that we will restore the material in 10 to 14 business days unless the complainant files a court action seeking an order to restrain the user from infringing activity related to the material;
- Restore the material if no court action is filed in that window.
7. Repeat-infringer policy
In accordance with 17 U.S.C. § 512(i)(1)(A), we maintain and enforce a policy that provides for the termination of accounts of users who are repeat copyright infringers. We use a "three strikes" framework:
- Strike 1. First valid takedown notice against a user → content removed; user warned; first-strike notation on account.
- Strike 2. Second valid takedown notice within 12 months → content removed; account suspended pending response from the user; second-strike notation on account.
- Strike 3. Third valid takedown notice within 12 months → account permanently terminated; future signups from the same email or payment instrument may be blocked.
We may apply this policy more strictly in egregious cases (for example, large-scale ripping of a single rights holder's catalogue) and may terminate immediately without prior strikes.
A "valid" notice is one that substantially complies with the DMCA's requirements. Counter-noticed strikes that result in restored content do not count toward this policy.
8. Trademark, right-of-publicity, and other non-DMCA complaints
The DMCA covers copyright only. For complaints about trademark infringement, right-of-publicity violations (use of a person's name, image, voice, or likeness without consent), defamation, or privacy violations, please email legal@kiriclip.com with a description of the issue, the URL or clip ID, and proof of your rights or identity. We review these case-by-case.
